This privacy policy applies to the FlowersforDreams.com web site and any services ("Services") available at FlowersforDreams.com (collectively, "Sites"), owned and operated by Flowers4Dreams LLC (collectively “F4D”, “we,” “us,” or “our”).

F4D is committed to maintaining your confidence and trust with respect to the information F4D collects from you. This Privacy Policy explains when and how F4D collects personal data, sets forth the information F4D collects about you, how F4D uses this information, and the choices you have about how F4D uses such information. Except as otherwise expressly set forth herein, the use of information collected through F4D's Services shall be limited to the purpose of providing the Services for which the customer has engaged F4D. If you do not agree with the terms, do not access or use the Services, Sites or any other aspect of F4D's business.

This Privacy Policy does not apply to any third-party applications or software that integrate with the Services through the F4D platform ("Third Party Services"), or any other third-party products, services or businesses. In addition, a separate agreement governs delivery, access and use of the Services and Sites ("Terms and Conditions of Use"), including the processing of any data, files or other content submitted through customer's or its user's use of the Service accounts (collectively, "Hosted Data"). Each customer entering into the Terms of Service controls their instance of the Services and any associated Hosted Data. The privacy practices outlined in this policy are incorporated by reference into the Terms and Conditions of Use.

COLLECTION OF INFORMATION

F4D may collect and receive Hosted Data and Service Data (collectively referred to as "Information") in a variety of ways:

Hosted Data: You may upload Hosted Data to F4D when using the Services. You control what Hosted Data is submitted to the Services, and may choose not to submit Hosted Data.

Service Data: “Service Data” may include information that identifies, relates to, describes, references, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or device ("Personal Information"). F4D also collects, generates and/or receives Service Data:

• F4D may request users of the Sites and Services to provide personal data such as name, email address, phone number, address, payment information, and username and passwords; and business information such as company name and address (other than Hosted Data).
• When making purchases through the Sites and Services online, you may provide F4D (or its payment processors) with billing details such as credit card information, banking information and/or a billing address, a gift message, and information about a recipient of a gift or purchase you make through the Sites and Services.
• The Sites and Services may provide you with messaging capabilities for your use. In the event you voluntarily disclose sensitive or personal data using such services, that information, along with any substantive information disclosed in your communication or post, can be collected, correlated and used by specific third parties. Any use of such Information shall be for the limited and legitimate purposes for which F4D is using such third party’s product or service to provide the Service or Site to you.
• When you interact with the Services and Sites, metadata is generated and gathered automatically that provides additional context about the way you work. This information may include internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, the files viewed on F4D’s sites (e.g., HTML pages, graphics, etc.), operating system, date/time stamp, and/or clickstream data in order to analyze trends in the aggregate and administer the Sites. F4D also collects information about devices accessing the Services and Sites, including type of device, what operating system is used, devise settings, application IDs, unique device identifiers and crash data.
• Whether F4D collects some or all of this Service Data often depends on the type of device used and your settings.
• We may receive information about you from other sources, such as third parties (lead generation sources) from whom we obtain data, and combine this data with information we already have about you. This helps us to update, expand and analyze our records, identify new customers, and provide products and services that may be of interest to you. If you provide us personal information about others, or if others give us your information, we will only use that information for the specific reason for which it was provided to us. Examples of the types of personal information that may be obtained from third parties and combined with information we already have about you, may include contact information such as name, email business address, and phone number.
• F4D may also receive personal information from social media platforms. Please consult with the third party's website for further information before you link or connect to the F4D Services and on how to control or adjust your privacy settings on that site. F4D has no control over such third party websites.

In accordance with the California Consumer Privacy Act of 2018 (“CCPA”), F4D discloses that its Sites may have collected the following categories of Personal Information from its Customers within the last 12 months:

• Various identifiers, including name, address, online identifier, Internet Protocol address, email address, account name, or other similar identifiers.
• Personal information categories listed in the California Customer Records statute (Cal. Civ. Code § 1798.80(e)), including telephone number, bank account number, credit card number, debit card number, or any other financial information (to the extent Customer purchases a paid version of the Services provided by F4D).
• Commercial information, including records of products or services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies.
• Biometric information, including behavioral characteristics, or activity patterns used to extract a template or other identifier or identifying information.
• Internet or other similar network activity, including browsing history, search history, information on a consumer's interaction with a website, application, or advertisement, including protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, the files viewed on F4D’s sites (e.g., HTML pages, graphics, etc.), operating system, date/time stamp, and/or clickstream data in order to analyze trends in the aggregate and administer the Sites.

Cookies/Tracking Technologies/Passive Collection:

• F4D and its partners use cookies or similar technologies in the Services and Sites to analyze trends, administer the Sites, track users' movements within the Sites, and to gather demographic F4D collects information automatically regarding your use of the Sites through the use of cookies. Cookies are unique alphanumeric identifiers sent to your browser from a website's computers and stored on your computer. The type of information F4D collects as a result of a cookie being stored on your computer includes the Internet protocol (IP) address used to connect your computer to the Internet; computer and connection information such as browser type and version, operating system, and platform; and click stream data, including date and time, cookie F4D collects and uses, and may from time to time supply third parties with, pseudonymized, aggregated user data for the purposes of site usage analysis, quality control and improving the Sites. F4D uses temporary "session" cookies to maintain information F4D needs to have in order for you to view content and browse from page to page. F4D uses "persistent" cookies to give you a more personalized browsing experience and to help you navigate. You can prevent your browser from accepting new cookies, have the browser notify you when you receive a new cookie, or disable the cookies through your browser settings. With respect to the Site, certain cookies are necessary for F4D to operate and disabling any such cookies may result in the inability to use or access the Site or Services. If cookies are disabled, you may not be able to take advantage of some of the Site features.

Third Parties

F4D may disclose your Personal Information to a third party for a business purpose. F4D may share your personal information with service provides, including software services providers and individuals who perform functions on our behalf. F4D will not sell your Personal Information to third parties, and has not sold your Personal Information to third parties in the preceding twelve (12) months.

F4D may disclose the following to third parties:

• F4D may share Service Data with its corporate affiliates, parents and/or subsidiaries (if any).
• F4D may employ other companies, software services and individuals to perform functions on its behalf. Examples include storing and processing data, providing marketing assistance, email and chat services and contract management. Such third parties have access to personal data as needed to perform their functions, but may not use it for other purposes. F4D integrates the web analytics tool Google Analytics in its Services and Sites. Google Analytics uses cookies and collects and processes Information. • The Sites may contain links to other websites that are beyond F4D's control. You should check the privacy settings and notices in these third party services to understand what data may be collected and disclosed by these third party services. In the event you choose to access such websites, F4D is not responsible for any actions or policies of such third parties. F4D recommends that you check the applicable privacy policy, including, with respect to cookies, of such party before submitting any information to them.
• F4D will release account and other personal data when F4D believes such release is appropriate to comply with applicable laws; enforce or apply F4D's Terms of Service; or protect the rights, property or safety of F4D's customers or others.
• Other than as set out above, F4D will provide you notice when your Information may be shared with a third party, and you will have an opportunity to choose not to share such Information.

Generally, no one is under a statutory or contractual obligation to provide any Information. However, certain Information is collected automatically. Additionally, if certain Information is not provided by you, such as setup details or billing information, F4D may be unable to provide the Services and/or Sites.

HOW PERSONAL DATA IS USED

F4D uses the Information that you provide for completion and support of the activity for which the information was provided, such as allowing access to or delivery of F4D's products or Services or responding to your requests or inquiries, or as otherwise required by applicable law.

F4D also may use the Information in furtherance of F4D's legitimate interests in operating F4D's Sites, Services and business. More specifically, F4D uses Information:

• for site and system administration such as for the technical support of the Sites and its computer systems, including processing computer account information, information used in the course of securing and maintaining the Sites, and verification of activity on the Sites by F4D or its agents.
• to conduct research and development to enhance, evaluate, and improve the Sites and Services.
• as required by applicable law, legal process or regulation.
• to develop and provide additional tools and features for the Sites and Services.
• to send emails and other communications. F4D may send you service, technical and other administrative emails, messages and other types of communications. F4D may also contact you to inform you about changes in the Sites, Services and important related notices, such as security and fraud notices. In addition, F4D may sometimes communicate with you about special offers or promotions, new product features or other news about F4D and its Services. These are marketing messages so you can control whether you receive them.
• for payment and order processing. F4D may provide such necessary information to our employees, contractors, agents, and designees to the extent necessary for them to perform services for use, including but not limited to, order fulfillment.
• for billing, account management and other administrative matters. F4D may need to contact you for invoicing, account management and similar reasons and F4D uses account data to administer accounts and keep track of billing and payments.
• to investigate and help prevent security issues and abuse.

F4D will not collect additional categories of Personal Information or use the Personal Information we collected for materially different, unrelated, or incompatible purposes without providing you notice.

F4D'S COMMITMENT TO DATA SECURITY

The security and confidentiality of your Information is important to F4D. F4D works hard to protect Information you provide from loss, misuse or unauthorized access or disclosure, and follows generally accepted industry standards to protect the personal data submitted to F4D, both during transmission and once it is received. F4D has implemented appropriate technical and organizational measures to ensure a level of security appropriate to the risk. Given the nature of communications and information processing technology, F4D cannot guarantee that Information, during transmission or while stored on F4D's systems or otherwise in its care, will be absolutely safe from intrusion by others. It is important that you protect against unauthorized access to your account information and to your computer. In certain situations, we may be required to disclose personal data in response to lawful requests by public authorities, including to meet national security or law enforcement requirements.

ACCESS

• Customers of F4D: In the event you are a F4D customer, upon request, F4D will provide you with information regarding whether F4D holds any of your personal data. You may access, correct, or request deletion of your personal data by contacting F4D at privacy@FlowersforDreams.com. F4D will respond to your request within a reasonable timeframe.
• Non-Customers of F4D: F4D acknowledges that you have the right to access your portable personal data. F4D has no direct relationship with the individuals whose personal data it processes. An individual who seeks access, or who seeks to correct, amend, or delete inaccurate data should direct their query to the F4D customer within whose account your data exists (the data controller). If requested to remove data F4D will respond within a reasonable timeframe.

CALIFORNIA RESIDENT RIGHTS

California residents have certain rights with respect to the personal information collected by businesses. If you are a California resident, you may exercise the following rights regarding your personal information, subject to certain exceptions and limitations:

• The right to know the categories and specific pieces of personal information we collect, use, disclose, and sell about you, the categories of sources from which we collected your personal information, our purposes for collecting or selling your personal information, the categories of your personal information that we have either sold or disclosed for a business purpose, and the categories of third parties with which we have shared personal information;
• The right to request that we delete the personal information we have collected from you or maintain about you.
• The right to opt out of any sale(s) of your personal information, should F4D ever sell such information in the future.
• The right not to receive discriminatory treatment for the exercise of the privacy rights conferred by the CCPA.

To exercise the access, data portability, and deletion rights described above, please submit a verifiable consumer request to us:

Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your Personal Information. You may also make a verifiable consumer request on behalf of your minor child.

Any verifiable request must include sufficient information that allows us to reasonably verify you are the person about whom we collected Personal Information (or an authorized representative) and describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it. We cannot respond to your request or provide you with Personal Information if we cannot verify your identity or authority to make the request and confirm the Personal Information relates to you.

Making a verifiable consumer request does not require you to create an account with us. However, we do consider requests made through your password protected account sufficiently verified when the request relates to Personal Information associated with that specific account.

DATA RETENTION

F4D retains Hosted Data in accordance with your instructions as defined in applicable terms in the Terms of Service or, where applicable, other services agreements, or as otherwise required by applicable law.

F4D may retain your Service Data for as long as your account is active or as needed to provide you Services, comply with F4D's legal obligations, resolve disputes, and enforce agreements, and thereafter, F4D shall destroy or delete such Service Data within 18 months, unless otherwise required for business purposes. Notwithstanding the foregoing, F4D may keep any data after the periods set forth in this section to the extent such data is anonymized or as necessary for business purposes. CHOICE

F4D partners with a third party to manage F4D's advertising on other sites. F4D's third party partner may use cookies or similar technologies in order to provide you advertising based upon your browsing activities and interests. You have a choice about whether or not you wish to receive certain information from F4D. You may choose to receive email-based, text-based and in-application messages from F4D. If you would like to discontinue receiving this information, you may update your email preferences by using the "Unsubscribe" link found in the emails F4D sends to you or by changing your notification preferences by clicking the "My Settings" link from within the application. You may also opt out of marketing-related email communications by using the "Unsubscribe" link found in the emails F4D sends to you or by contacting F4D at help@FlowersforDreams.com. ou may also opt out of marketing-related text-based communications by using the STOP keyword in reply to messages F4D sends to you or by contacting F4D at help@FlowersforDreams.com. You may not be able to opt-out of certain notifications to the extent necessary to comply with applicable law or legal process and to prevent fraud or security issues.

ABOUT THIS PRIVACY POLICY

If you choose to use the Service or visit the Site, your use, visit and any dispute over privacy is subject to this Privacy Policy. F4D may change this Privacy Policy from time to time. Any changes to this Privacy Policy will be posted on this page so that you are always aware of F4D's policies. If F4D makes any material changes, F4D will notify you by means of a notice on this website or within the F4D Sites, or by email (sent to the e-mail address specified in your account), prior to the change becoming effective. F4D encourages you to periodically review this page for the latest information on privacy practices. If you disagree with the changes to this Privacy Policy, you should deactivate your Services account and/or cease use of the Sites.
